Terms and conditions

These terms govern your use of On My Nails (onmynails.com) and its related services, including our apps (the “Service”), provided by TEXTINTEL FZE, Starcamp Global, DWTC The Offices One, Office Number 01.03, Dubai, United Arab Emirates (“we”, “us”, “our”). By using the Service, you agree to these terms, to our privacy policy and to our community guidelines. If you do not agree, do not use the Service.

The Service lets you browse nail designs, design styles and concepts on a 3D hand, and see them drawn on a photo of your hand or live through your camera. The drawing happens on your device. Plus subscribers can also make styles with an AI style generator.

Renderings are previews. How a set looks on your photo, on the 3D hand or in live try-on depends on the photo, the light and the device, and may differ from a real manicure. Review results before you use or publish them.

• You must be at least 13 years old to use the Service, and at least 18, or the age of majority where you live, to buy Plus.
• You can use the Service without signing in. Your work is then kept for this browser only: it can be lost if you clear your browser’s data, and it is deleted after 30 days without activity. Sign in to keep it on every device.
• Publishing, making a collection public, changing your handle and subscribing require a signed-in account.
• One account per verified email address. Keep your sign-in methods secure; you are responsible for activity under your account.
• Your handle and display name must follow the community guidelines. We may reset a handle that does not.

The Service is free to use within the limits shown in the Service. Plus is a subscription that adds AI styles and removes the free limits on custom styles, concepts, generations and live try-on.

• Plus is offered as a weekly, monthly or yearly subscription. On the web it is billed by Stripe; in our apps, by the app store. The price, the billing period and any taxes are shown before you subscribe.
• Plus renews automatically at the end of each period until you cancel. You can cancel at any time in Settings, Plan, Manage billing (or in the app store for a store subscription). Plus then continues until the end of the paid period.
• Changing to a longer or shorter period: an upgrade starts at once and the charge is adjusted for the time left; a change to a shorter period starts at the next renewal.
• If a renewal payment fails, Plus may continue while the payment is retried, and ends if it cannot be collected.
• We may change prices or the free limits with notice. A price change applies from your next billing period.
• When Plus ends, everything you made stays and can be edited, published or deleted. The free limits apply again: above a limit, you can make new styles or concepts once you are under it.
• A plan belongs to your account and cannot be transferred.

You can cancel Plus at any time; it then continues until the end of the period you paid for. You may also request a full refund of your latest Plus payment within fourteen (14) days of the charge by contacting support@onmynails.com. A refund ends Plus at once; your work stays. Refunds of app store purchases are handled by the store under its own rules.

This does not affect any rights you have under applicable law.

You keep all rights you have in the photos, art, prompts and designs you add to the Service and in the results made from them (“your content”). You grant us a limited licence to host, store, process and display your content only as needed to provide the Service to you.

When you publish a look, a style or a concept, or make a collection public, you also grant us a worldwide, non-exclusive, royalty-free licence to host, reproduce (for example, as covers, thumbnails and social cards), display and distribute it on the Service and in links to it, and you allow other users to view it, save it, try it on, use your published styles in their concepts, and remix it with credit to you. For a published style or concept that other users’ concepts or generations use, this licence continues after you unpublish or delete it, so their work keeps working (it is then shown without your name).

You confirm that you own or have the right to use everything you upload or publish, including uploaded art, and that you have the consent of anyone whose hand appears in a photo you publish.

• Everything published is checked automatically before anyone else sees it, and may be held for review by our staff. We may refuse, hide or remove any public content, and reset a handle, that breaks these terms or the community guidelines, or the law.
• A style that is removed disappears from every concept that uses it.
• An edit to a published style applies everywhere the style is used, including other users’ concepts, once it passes the check.
• A remix names its source automatically. You may not remove or misstate that credit.

The AI style generator sends your prompt and optional reference photo to a third-party image provider, as described in the privacy policy. Results are made automatically and may be refused by safety checks. Do not submit a photo or a description you have no right to use, or that shows a person’s face or private information. You are responsible for how you use a result.

You agree not to:

• upload or publish content that is unlawful, infringing, sexual, hateful, violent, abusive or that you have no right to use;
• publish content that sexualises or endangers minors, or a photo of another person without their consent;
• harass, impersonate or mislead others, or spam the Service;
• misuse, interfere with, copy, scrape, resell or reverse engineer the Service;
• get around the free limits, for example by creating accounts in bulk or by automated means.

We may suspend or terminate your access, or restrict publishing, if you breach these terms or the guidelines, or if required by law. You may stop using the Service and delete your account at any time.

The Service, including its software, design, 3D hand, official styles, concepts and art, and its brand, is owned by us or our licensors and is protected by intellectual property laws. You may use official styles and concepts within the Service.

Some parts of the Service are provided by third parties, such as sign-in with Google or Microsoft, payments by Stripe or an app store. Their own terms apply to those services.

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error free, or that a rendering will match a real manicure.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue or data. Our total liability for any claim is limited to the amount you paid us in the twelve (12) months before the claim. Any claim must be brought within one (1) year after it arose. Nothing in these terms limits liability that cannot be limited by law.

We may update these terms from time to time. The updated version applies from the date it is posted. If a change is significant, we will tell you in the Service before it applies. Continued use of the Service means you accept the updated terms.

These terms are governed by and construed in accordance with Turkish law. Any dispute arising under these terms is subject to the exclusive jurisdiction of the Turkish courts, without prejudice to any mandatory consumer protection rights you have where you live.
